Terms and Conditions of Sale (T&Cs) Pokelu

These T&Cs apply subject to the mandatory provisions of Swiss law, in particular Articles 197 et seq. of the Swiss Code of Obligations.

1) Seller information

These T&Cs apply to all orders placed on the website [pokelu.ch] and to all sales concluded between:

Customer: any person who places an order via the website.

These T&Cs apply as soon as the Customer validates their order.


2) Contract

2.1 Formation of the contract (order)

The validation of the order by the Customer constitutes an offer to purchase.

The sending of an automatic confirmation email does not yet constitute definitive acceptance of the contract.

The contract is deemed concluded only after:

  • effective validation of the payment,

  • and express confirmation of the shipment of the product by Pokelu KLG.

Pokelu KLG reserves the right to refuse or cancel an order before this definitive confirmation, in particular in the event of unavailability.

2.2 Manifest error, exceptional unavailability or technical error

In the event of a manifest error concerning the price, description, available quantity or any other essential information resulting from a technical, IT, human error or system malfunction, Pokelu KLG reserves the right to cancel all or part of the affected order.

Such an error shall not engage the liability of Pokelu KLG if it was objectively recognizable as such or results from a technical problem beyond its control.

In the event of cancellation:

  • the Customer will be informed as soon as possible;

  • any amounts paid will be fully refunded;

  • no additional compensation may be claimed.


3) Products, visuals, language, condition

3.1 Visuals

The visuals displayed on the website are provided for illustrative purposes. They may not correspond exactly to the item shipped (examples: language shown on an image, symbol placement, minor printing variations, packaging).

3.2 Product language

The actual language of the product is indicated on the product page via a visual marker (flag) and/or a “Language” field. In the event of any discrepancy between a visual and the stated language, the language shown on the product page shall prevail.

3.3 Card condition and standards

For single cards, the stated condition (e.g., NM, EX, GD) is a reasonable assessment based on our internal criteria and does not constitute a grading score.

Unless otherwise stated on the product page, factory variations (e.g., centering, small ink dots, cut) are not considered defects.


4) Prices, currencies, and taxes

4.1 Contract currency

Prices are displayed in CHF and EUR.

The reference and payment currency is CHF, unless otherwise stated at the time of payment.

The EUR price is provided for information purposes only (automatic conversion). In case of discrepancy, the CHF amount shall prevail.

4.2 VAT and fees

Any applicable taxes (including VAT if applicable) and delivery fees are shown at the latest before final order validation.


5) Payment

Available payment methods are those displayed on the website at the time of ordering (including credit/debit cards, TWINT, bank transfer, or other offered methods).

Payment is due immediately upon placing the order.

The order will only be processed and shipped after successful payment authorization by the payment provider or, in the case of bank transfer, after effective receipt of the funds.

In the event of payment failure or refusal, the order will be automatically cancelled.

Payments are processed through certified payment providers. Banking and card details never pass through the servers of Pokelu KLG.


6) Delivery

Delivery area: Switzerland
Lead times: displayed delivery times are indicative, unless stated as “guaranteed” or covered by a specific commitment.

The Customer must check the parcel upon receipt. If the parcel is clearly damaged, the Customer must document it (photos) and contact us according to the “Claims” procedure.

Risk is transferred to the Customer when the parcel is handed over to the carrier, in accordance with Swiss law, subject to any transport insurance that may have been taken out. In the event of a dispute after handover to the carrier, Pokelu KLG may assist the Customer in opening an investigation with the carrier, without guaranteeing reimbursement.


7) Inspection upon receipt and notice of defects

The Customer must inspect the products upon receipt and inform us promptly in case of any issue.


8) Claims: accepted cases and procedure

8.1 Accepted cases

We handle claims in the following cases:

  • picking error (wrong item, incorrect quantity)

  • transport-related damage

  • proven defect (within the meaning of Swiss law) or non-conformity with the description

8.2 Mandatory procedure

The request must be sent to info@pokelu.ch with:

  • order number

  • description of the issue

  • clear photos of the parcel (outside), inner packaging, and the product

  • photo of the shipping label if possible

Recommended timeframes:

  • transport damage: within 48 hours

  • picking error: within 7 days

  • non-apparent defect: immediately upon discovery

The Customer must keep the product and packaging in the received condition until the case is closed.


9) No returns for convenience

Unless Pokelu KLG expressly offers otherwise in writing, no returns are accepted for change of mind.


10) Returns, product integrity, and anti-fraud policy (all products)

This section applies to all products: single cards, graded cards, sealed products, accessories.

10.1 No acceptance of tampered or damaged products

Any return or claim may be refused if the product shows signs of:

  • handling, attempted opening, repackaging

  • substitution (different product), missing contents

  • humidity, abnormal odor, excessive pressure, bends, scratches inconsistent with transport damage

  • damage not attributable to transport or to an error by Pokelu KLG

10.2 Sealed products

For sealed products: no return is accepted if the seal is open, missing, replaced, lifted, or damaged.

10.3 Evidence and inspection

Pokelu KLG reserves the right to:

  • document products before shipping (photos, weight, logistics references),

  • require a return for inspection before making a decision,

  • refuse a request in case of serious indications of abuse or inconsistency.


11) Legal warranty (defects), card condition, and limits

In the event of a defect under Swiss law or if a product does not match its description, the Customer may have statutory rights (for example, price reduction or rescission), subject to the legal requirements.

11.1 Single cards: condition is part of the description

For single cards, the stated condition (e.g., NM, EX, GD, Good, etc.) is part of the product description.

If a card is sold in “Good” condition, it means it has visible defects (e.g., whitening, scratches, worn corners, play wear, slight warping). These expected defects, compatible with the stated condition, are not considered a defect.

However, a remedy may apply if the card is materially worse than the stated condition, if a significant issue is not compatible with the description, or in case of an error on an essential element (e.g., wrong card, wrong edition, wrong language, incorrect quantity, counterfeit).

11.2 Second-hand items

For items sold as second-hand, a reduced time limit may apply if contractually provided. At Pokelu KLG, single cards are generally considered second-hand items, unless marked as “new” or “sealed”.

The fact that an item is second-hand does not automatically exempt it from VAT. VAT depends on whether Pokelu KLG is VAT-registered and on the VAT scheme applied (for example standard taxation, or margin taxation where permitted by law).

11.3 What is not covered

The warranty and any remedy do not cover:

  • normal wear and defects already disclosed or clearly compatible with the stated condition,

  • factory variations (e.g., centering, micro-dots, cut) unless otherwise stated,

  • damage occurring after delivery or caused by improper handling,

  • damage resulting from insufficient return packaging.

The Customer must inspect the products upon receipt and report any issue promptly, with photos, according to the “Claims” section.


12) Authenticity

Pokelu KLG implements checks and traceability measures aimed at significantly reducing the risk of counterfeits.

If the Customer has a serious and substantiated doubt about authenticity, they must contact Pokelu KLG immediately and before any action on the product (resale, repackaging, attempted opening). We will then indicate the analysis and resolution procedure.


13) Liability

Pokelu KLG is liable for damages within the limits of the applicable law.

To the extent permitted by law, Pokelu KLG excludes liability for:

  • indirect damages,

  • loss of business,

  • loss of profits.

This exclusion does not apply in case of intent or gross negligence, nor where the law prohibits such exclusion.


14) Data protection

Personal data is processed in accordance with applicable Swiss law. Privacy policy: Privacy Policy.


15) Applicable law and jurisdiction

Swiss law applies.

For consumers, mandatory jurisdictions provided by law apply. The parties cannot waive them in advance.


16) Final provisions

If any clause is held invalid, the remainder of these T&Cs remains in force. Pokelu KLG may amend these T&Cs; the version in force at the time of the order applies.
